In Utah County, divorce cases are handled by the Fourth District Court, located in Provo. The court clerk's office maintains complete case materials: divorce decrees, property division agreements, child custody orders, and all related procedural documents.

The state maintains a separate record. The Utah Office of Vital Records and Statistics issues divorce certificates — a concise document confirming the dissolution of marriage but not containing details of the court decision.

Divorce records filed since 1896 are often kept directly in district courts. Older records may have been transferred to the Utah State Archives. To search for court cases online, use the Xchange system — a public search of Utah state court cases.

Where Divorce Records Are Filed in Utah

Divorces in Utah are processed exclusively through the District Court. There is no separate family court — divorce cases fall under the jurisdiction of the district court in the county where the plaintiff or defendant resides. For Utah County, this is the Fourth District Court in Provo.

After a decision is made, the court notifies the Office of Vital Records, which creates a state-level divorce record. Therefore, there are two different types of documents, and you need to contact different institutions depending on the purpose of your request:

  • Complete court materials (decisions, agreements, custody orders) — Fourth District Court clerk's office. You can submit a court record request or search through Xchange.
  • Divorce certificate (confirmation of marriage dissolution) — Utah Office of Vital Records. Orders are available online, by mail, or in person.

Historical records transferred from district courts can sometimes be found in the Utah State Archives. If a case was filed before 1896 or the court transferred old materials for storage, start your search there.
