What Types of Cases Utah County Courts Hear

The courts serving the county handle a wide range of cases. Here are the main categories:

  • Criminal cases: felonies, misdemeanors, infractions
  • Civil lawsuits and small claims
  • Family law: divorce, custody, alimony, protective orders
  • Probate: estate administration, guardianship, conservatorship
  • Juvenile cases: juvenile offenses, child protection, adoption
  • Traffic violations and DUI cases

Each of these categories is described in detail below.

District Court Cases in Utah County

The Fourth District Court handles the most serious cases. These include criminal felonies after a preliminary hearing in a court of limited jurisdiction, civil lawsuits with no monetary limit, appeals from the Justice Court, and post-conviction proceedings. Cases are distributed among district court judges according to the county's internal rules. A presiding judge is appointed for each specific case. A civil lawsuit begins with the filing of a complaint, and criminal prosecution starts with an information or indictment from the prosecutor.

Magistrate Court Cases in Utah County

In Utah, the Justice Court functions as a court of limited jurisdiction. Utah County Justice Court handles Class B and C misdemeanors, infractions, traffic violations, DUI cases at the arraignment stage, as well as civil claims up to $11,000 and small claims up to $11,000. Preliminary hearings in felony cases may also be conducted at the Justice Court level, after which the case is transferred to the district court. A Justice Court judge may specialize in certain categories of cases depending on the court's workload. Decisions from the Justice Court can be appealed to the district court.

Family Law, Probate, and Juvenile Matters in Utah County

Family Law

Cases involving divorce, child custody, alimony, protective orders, paternity establishment, and termination of parental rights are handled by the Fourth District Court. To obtain marriage or divorce certificates, contact the Utah Office of Vital Records. Historical divorce records are also available through the civil court case archives.

Probate

Estate administration for deceased persons, appointment of guardians and conservators, and trust matters fall under the jurisdiction of the district court. Filing begins with a petition to the court, after which a judge schedules a hearing.

Juvenile Matters

The Utah Juvenile Court handles cases involving juvenile offenses and child protection matters. Juvenile court records are confidential under state law. Public access to these cases is restricted and can only be obtained with proper authorization.

How Cases Move Through the Utah County Court System

A typical case progression through the county's court system looks like this:

  1. Case Initiation: filing of a criminal complaint, civil lawsuit, or petition (e.g., in family or probate matters).
  2. Judge Assignment: the case is assigned to a specific judge according to the court's internal rules.
  3. Initial Hearing: in criminal cases — arraignment (first court appearance); in civil cases — scheduling conference.
  4. Pre-trial Phase: filing of motions, discovery, plea negotiations in criminal cases, or settlement negotiations in civil cases.
  5. Trial or Resolution: jury or judge verdict, settlement agreement, guilty plea, or default judgment.
  6. Post-trial Stage: sentencing, appeal filing, judgment enforcement.

Cases in the Justice Court follow a shortened procedure. A traffic violation may be resolved in one or two sessions.

Court Administration, Local Rules, and Public Access in Utah County

The Fourth District courts are administered by the district's presiding judge and court administrator. Local court rules are published on the Utah State Courts website, where the general rules of judicial administration (Utah Code of Judicial Administration) are also available.

Regarding public access to records: most court records in Utah are public according to Rule 4-202 of the Code of Judicial Administration. However, some records — particularly in civil cases after changes from April 2012 — may be classified as private. Juvenile court records, adoption cases, and sealed cases are not subject to public access.

To obtain records maintained by the county, a written GRAMA request must be submitted. This can also be done through the county's online public request portal or the state's Open Records Portal.

Hearings in most cases are open to the public. Some sessions are conducted remotely via Webex or another platform — check with the specific court's clerk's office.
